Greetings to all:

I was going to register on your site until I noticed your indemnification clause.  In general I am very reluctant to agree to such provisions.  Yours specifically is open ended as to what actions would trigger liability as well as open ended as to the amount of money I might be liable for (limitless).  Even insurance indemnity contracts limit what conditions are covered and also limit the amount of money (policy limit).  As a mere individual I have far less ability to indemnify than an insurance company.

Under these conditions I feel I cannot register for your site.  If you remove the indemnification language then I would be pleased to sign up.  Or, if you strictly limit the conditions of liability (for example I do something intentionally wrong that actually damages you) as well as the amount of money, I would also consider registering.

No offense intended, I am just expressing my opinion as I was requested to do.  I have been practicing law for over 35 years and have experience with indemnification.  Thanks for listening.  I enjoy playing COD2 on your site and you seem to have a good group of people.

was good to chat with you on TS the other night baout this

it is as I said just a standard clause that is setup automatically when you install the forums,
we will likely look at it at some point and maybe take the advce to clean it up a bit
it has not been considered yet as it was the default generic message that was included with the forum installations

I would guess Attorneys do, that's in their blood to go over every single word in a contract.
Did you ever see that Southpark episode when Kyle did not read the ELUA from Apple? Was a good one.

strange i never saw this thread in the past but recently i read about the agreements we *agree to when for instance, purchasing a game from Steam. often the agreement will state certain things that we are liable for and if you understood it in layman's language, it might make you gag. the fact is that we just say "I agree" and go play the game. after reading the article i tried to read an agreement in its entirety but admittably fell asleep after the 14th paragraph. might havta hire a lawyer.

nb-sadly i went thru my email inbox and have deleted the article discussing this issue.
